{"id":934,"date":"2016-01-21T15:53:01","date_gmt":"2016-01-21T20:53:01","guid":{"rendered":"https:\/\/www2.law.temple.edu\/voices\/?p=934"},"modified":"2016-07-28T12:03:20","modified_gmt":"2016-07-28T16:03:20","slug":"autonomous-legal-reasoning-legal-and-ethical-issues-in-the-technologies-of-conflict","status":"publish","type":"post","link":"https:\/\/www2.law.temple.edu\/voices\/autonomous-legal-reasoning-legal-and-ethical-issues-in-the-technologies-of-conflict\/","title":{"rendered":"Autonomous Legal Reasoning: Legal and Ethical Issues in the Technologies of Conflict"},"content":{"rendered":"<p>One of the highlights of my\u00a0Fall semester was the opportunity to host a <a href=\"http:\/\/www7.law.temple.edu\/events\/autonomous-legal-reasoning-conference\/\" target=\"_blank\">one-day workshop<\/a> at Temple Law on how autonomous technology may impact the future of international humanitarian law (IHL) and the lawyers who practice it. \u00a0With co-sponsorship from the <a href=\"https:\/\/www.icrc.org\/en\/where-we-work\/americas\/united-states-america\" target=\"_blank\">International Committee of the Red Cross<\/a> (specifically, Rob Ramey and Tracey Begley) as well as\u00a0<a href=\"http:\/\/www.mcu.usmc.mil\/Pages\/faculty_pages\/chairs\/Gary-D-Brown.aspx\" target=\"_blank\">Gary Brown<\/a> of Marine Corps University, we wanted to have an inter-disciplinary conversation on the way autonomy may implicate the practice of law across a range of new technologies, including cyberwar, drones, and the potential for fully autonomous lethal weapons. \u00a0Although these technologies share common characteristics \u2014 most notably their ability (and sometimes their need) to operate in the absence of direct\u00a0human control \u2014 discursive silos have emerged where these technologies tend to be\u00a0discussed in isolation.<\/p>\n<p>Our workshop sought to bridge this divide by including experts on all three technologies from an array of\u00a0disciplinary backgrounds, including IHL, political science, and ethics (see <a href=\"http:\/\/www7.law.temple.edu\/events\/autonomous-legal-reasoning-conference\/participants\/\" target=\"_blank\">here <\/a>for a list of participants). \u00a0Fortunately, the day itself lived up to the hype, with <a href=\"http:\/\/www7.law.temple.edu\/events\/autonomous-legal-reasoning-conference\/agenda\/\" target=\"_blank\">a detailed agenda<\/a> that prompted a wide-ranging set of conversations on the nature of the technology, the ethical issues, as well as IHL\u2019s current regulations and its likely future evolution. \u00a0Subject to the Chatham House Rule, the ICRC has published <a href=\"http:\/\/intercrossblog.icrc.org\/blog\/048x5za4aqeztdiu3r8f96s8m7lzom#sthash.cqZboGtC.dpbs\" target=\"_blank\">summaries of these conversations<\/a>\u00a0on their blog, <a href=\"http:\/\/intercrossblog.icrc.org\/\" target=\"_blank\">Intercross<\/a>.<\/p>\n<p>In addition to those blog posts, the <a href=\"http:\/\/www.temple.edu\/law\/ticlj\/\" target=\"_blank\">Temple International and Comparative Law Journal<\/a> will publish a series of short (and often provocative) think-pieces written for the workshop. \u00a0My own contribution, <em><a href=\"http:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2711304\" target=\"_blank\">Setting the Stage: Autonomous Legal Reasoning in International Humanitarian Law<\/a><\/em>\u00a0is now available on <a href=\"http:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2711304\">SSRN<\/a>. \u00a0Here\u2019s the abstract:<\/p>\n<blockquote><p>This short essay seeks to reorient \u2014 and broaden \u2014 the existing discourse on international humanitarian law (IHL) and autonomous weapons. Written for a conference co-sponsored by the International Committee of the Red Cross, it employs a contextual analysis to pose new questions (and reformulate others) regarding the relationship between IHL and autonomous weapon systems. It asks six questions: (1) Who should IHL regulate in this context? Does IHL only regulate States and individuals, or can it provide rules for autonomous weapon systems themselves? (2) What types of autonomous technology should IHL regulate? Should the current focus on kinetic weapons expand to encompass cyber operations? (3) Where should this discourse occur? How do the trade-offs involved in locating legal discourse in a particular forum impact the elaboration of IHL vis-\u00e0-vis autonomous systems? (4) When should IHL regulate autonomous weapons? Should IHL ban autonomous weapons now or allow its regulation to emerge incrementally over time? Can IHL only apply when an autonomous system\u2019s operations constitute an attack, or should IHL\u2019s application reach more broadly? (5) How should IHL regulate autonomous weapon systems? Are prohibitions better or worse than prescriptive authorities? Should IHL regulate via rules, standards, or principles? Finally, (6) why should IHL regulate autonomous weapons? How can IHL best prioritize among its foundations in military necessity, humanitarian values, and the practical reality that the development of such systems now appears inevitable. In asking these questions, my essay offers a critical lens for gauging the current scope (and state) of international legal discourse on this topic.
