Lastly, what should I do?<\/p>\n<h4>What happened and what\u2019s to come<\/h4>\n<p>On January 27, 2017, President Trump issued an executive order temporarily banning immigrants and refugees from seven Muslim-majority countries, and from Syria indefinitely. The order\u2019s full text can be found <a href=\"http:\/\/www.npr.org\/2017\/01\/31\/512439121\/trumps-executive-order-on-immigration-annotated\">here<\/a>. After a tumultuous couple weeks, the ban has since been lifted.<\/p>\n<p>A Seattle federal judge named James Robart <a href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/federal-judge-temporarily-blocks-trumps-immigration-order-nationwide\/2017\/02\/03\/9b734e1c-ea54-11e6-bf6f-301b6b443624_story.html?utm_term=.1d17ed2f0776\">temporarily blocked<\/a> enforcement of Trump\u2019s travel ban in its entirety. On February 9th, 2017, the 9th Circuit Court of Appeals sided with the Seattle judge and completely repudiated the White House\u2019s attempt to restore the travel ban. Why? The constitutionality of the ban was put into question, and the government did not offer sufficient justification for why refugees and immigrants from seven specific countries were singled out as immediate threats.<\/p>\n<p>Trump immediately tweeted <a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/829836231802515457\">\u201cSEE YOU IN COURT,\u201d<\/a> which is likely a threat to appeal the decision and possibly an indication that this issue will soon be disputed again in front of the Supreme Court. Alternatively, Trump and his administration have suggested nixing the old order and instead <a href=\"http:\/\/www.foxnews.com\/politics\/2017\/02\/12\/trump-adviser-miller-says-new-executive-orders-on-illegal-immigration-option.html\">drafting a new executive order<\/a> to limit immigration.<\/p>\n<h4>Immigration Terms You Should Know<\/h4>\n<p>Before we dive into policy, let\u2019s start with some basic terms that are critical to understanding US immigration.<\/p>\n<p>A lawful permanent resident is a green-card holder. A green-card allows you to stay in the U.S. as long as you want with no expiration date &#8211; as long as you don\u2019t commit crimes or violate the green-card terms.<\/p>\n<p>A nonimmigrant visa is a temporary pass that lets someone stay in the U.S. for a specific amount of time. In contrast, an immigrant visa allows someone stay with the opportunity to become a permanent resident and apply for a green card. In order to obtain an immigrant visa, a U.S. citizen needs to petition for it on behalf of the immigrant.<\/p>\n<p>A refugee or asylum seeker is <a href=\"http:\/\/legal.un.org\/avl\/ha\/prsr\/prsr.html\">different from an illegal immigrant<\/a>. A refugee is a person outside of their country who is unable or unwilling to return home because they fear serious harm. He or she applies for asylum and then goes through security checks and vetting.<\/p>\n<p>Asylum is legal permission to stay in a country based on well-founded fear of persecution in one\u2019s home country. Vetting means to evaluate a person or thing, either as an appraisal, or for approval. See <a href=\"https:\/\/www.merriam-webster.com\/news-trend-watch\/trump-extreme-vetting-20170127\">\u2018extreme vetting\u2019<\/a>.<\/p>\n<h4>Policy You Should Understand<\/h4>\n<p>People have asked whether, in 2011, Obama enacted immigration policies similar to Trump\u2019s. Though there are some limited similarities, Trump\u2019s executive order and Obama\u2019s 2011 policy are fundamentally different.<\/p>\n<p>Here\u2019s a quick summary of the key differences between Obama\u2019s policy and Trump\u2019s executive order (click\u00a0image for full-size):<\/p>\n<p><a href=\"https:\/\/www2.law.temple.edu\/voices\/cms\/wp-content\/uploads\/2017\/02\/ObamaTrumpPolicy2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-1948\" src=\"https:\/\/www2.law.temple.edu\/voices\/cms\/wp-content\/uploads\/2017\/02\/ObamaTrumpPolicy2-300x265.jpg\" alt=\"\" width=\"300\" height=\"265\" srcset=\"https:\/\/www2.law.temple.edu\/voices\/cms\/wp-content\/uploads\/2017\/02\/ObamaTrumpPolicy2-300x265.jpg 300w, https:\/\/www2.law.temple.edu\/voices\/cms\/wp-content\/uploads\/2017\/02\/ObamaTrumpPolicy2.jpg 556w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>(For a more in-depth look at the differences between the two policies, please stay tuned.)<\/p>\n<h4>What you can do<\/h4>\n<p>The order caused global confusion for those trying to travel into the United States. The ban is no longer in place, meaning refugees and people from those seven countries can still enter the U.S.<\/p>\n<p>However, if you or a loved one fall into any of the affected categories, travel to and from any of the seven countries is still discouraged without first contacting an immigration attorney.<\/p>\n<p>The legal dispute will likely remain in limbo for some time ahead. With <a href=\"http:\/\/www.cnn.com\/2017\/02\/10\/politics\/democrats-question-ice-enforcement-raids\/index.html\">rising raid operations to deport undocumented immigrants<\/a> the past couple weeks, Trump is delivering on his promise to crack down on immigration. Especially if you are uncertain of your own legal status, speak with an attorney.
