Dean Epps was one of four recipients selected\u00a0nationwide for the award.<\/em><\/p>\n<p><em>The Spirit of Excellence Award\u00a0celebrates the efforts and accomplishments of lawyers who work to\u00a0promote a more racially and ethnically diverse legal profession. Awards are presented to lawyers\u00a0who excel in their professional settings; who personify excellence on the national, state, or local\u00a0level; and who have demonstrated a commitment to racial and ethnic diversity in the legal\u00a0profession. I also\u00a0want to thank my friends in the audience in support of me, including\u00a0good friends from Philadelphia: Steph, Bobbie, Nelson and colleague\u00a0Jonathan. And thank you Ron, the other Philadelphia Bobbi and Kim\u00a0for putting together a truly humbling nomination package and for all of\u00a0you, many here, who supported my nomination.<\/p>\n<p>They gave us only a few minutes, so I want to say a few words about\u00a0why I think the struggle for diversity still matters.\u00a0Let me start with a positive observation. This country should be\u00a0applauded for a half century of improvement in diversity. Heck, there\u00a0are black and brown people everywhere: flying planes, performing\u00a0surgery, running businesses \u2013 leading the ABA. We\u2019re everywhere \u2013\u00a0but not everywhere we should be. Almost everywhere you look \u2013\u00a0except the NBA and US prisons \u2013 minority participation and\u00a0opportunities are flatlining or dwindling. In the legal profession, the\u00a0numbers of minority partners, associates, and law students are stuck,\u00a0with only minor change over the last decade. This would be fine if\u00a0these numbers matched the population numbers. But we know they do\u00a0not. We have a numbers problem that starts with a pipeline problem.<\/p>\n<p>Among the solutions? We must make sure that a child\u2019s zip code\u00a0doesn\u2019t define the quality of education that child receives. I borrowed\u00a0the zip code reference from Philadelphia\u2019s recently elected Mayor Jim\u00a0Kenney, but he is right. In too many places, public education is\u00a0inadequate. And that\u2019s not right \u2013 because you can only take advantage\u00a0of opportunity if you\u2019re prepared. And education is key to being\u00a0prepared.<\/p>\n<p>Second, incivility is on the increase. I\u2019m sorry; you do not get to\u00a0publicly say whatever you think \u2013 and to defend that incivility by\u00a0saying you\u2019re rejecting political correctness. Islam is a religion and not\u00a0a political manifesto. And Mexicans and others of Hispanic heritage\u00a0enrich this country every day. The First Amendment has on many\u00a0occasions been a sword in favor of liberty and a shield against\u00a0repression. But just because you have the right to say something\u00a0doesn\u2019t mean you should say it. I know I sound as if I think I made it\u00a0to the presidential debate stage. I know where I am and I am grateful.\u00a0But incivility has been unleashed in this country. And we must label it\u00a0for what it is. And call it wrong.<\/p>\n<p>Third, when we think about diversity, we must ask ourselves what\u00a0diversity really means and why we care about it. Diversity is not just\u00a0&#8220;not a white male&#8221;. Those who are physically disabled can be seen,\u00a0but are too often overlooked. Many of our differences, however, are\u00a0hard to &#8220;see&#8221;. Those fighting depression, survivors of sexual assault,\u00a0those who must decide every day whether to come out as LGBTQ, or a\u00a0first generation college student who must balance gratitude against the\u00a0crushing weight of expectations. These are people who offer valid\u00a0perspectives \u2013 if we are open to receiving them. My point is that when\u00a0you think about &#8220;other&#8221;, compared to the person next to us, we are all\u00a0&#8220;an&#8221; &#8220;other&#8221;. We are all different. We are all, in some form or fashion,\u00a0diverse.<\/p>\n<p>Fourth, why is it important to force yourself to understand &#8220;other&#8221;?\u00a0Because implicit bias is everywhere. And the only way to combat\u00a0implicit bias is through awareness. Those of you who know me know\u00a0that I am usually a calm person. But inside there is a growing turmoil.\u00a0I am angry and I am sad. I am sick and tired, and I\u2019m sick and tired of\u00a0being sick and tired. And one of the reasons is the proliferation of\u00a0suggestions that, as a person of color, I am equated with all that is\u00a0wrong and bad in the world. Stay with me for a minute. Black Sheep,\u00a0black mark, black cloud, here\u2019s one of my favorites; angel\u2019s food cake\u00a0\u2013 devil\u2019s food cake. We\u2019ve all seen the ads for Star Wars, the Force Awakens. What color is Luke Skywalker (hero) wearing? Darth\u00a0Vader? Oh, I could go on and on and on and on.<\/p>\n<p>Some days I am angry. More often I am sad. But not for me. I\u2019ve had\u00a0an unbelievably blessed life \u2013 richer and more fulfilling than I could\u00a0have imagined or dreamed. I am sad for America\u2019s young people\u00a0growing up in a world where they see themselves \u2013 or others,\u00a0victimized \u2013 at best marginalized and at worst, maligned \u2013 explicitly\u00a0through incivility and implicitly through a relentless source of\u00a0subliminal messages \u2013 that &#8220;other&#8221; is unworthy.<\/p>\n<p>We can do better. We are a better country than this. So I work because\u00a0diversity is a goal worth celebrating. Commenting on this year\u2019s Oscar\u00a0nominations, actor and native Philadelphian Will Smith said &#8220;Our\u00a0diversity is this country\u2019s greatest strength&#8221;. I think he\u2019s right.<\/p>\n<p>So in fighting for diversity, I am fighting to ensure that young people\u00a0have \u2013 and feel they have \u2013 equal opportunity. I am fighting for them\u00a0to believe they can live their dream. I am fighting to make sure this is a\u00a0country where differences, of all sorts, are acknowledged and\u00a0respected, even if not admired. I am optimistic. Dr. Martin Luther\u00a0King, who in two years will have been gone 50 years, said this: &#8220;it\u2019s\u00a0only when it\u2019s dark enough that you can see the stars.&#8221; The motto of\u00a0the Spirit of Excellence Awards is &#8220;To the Stars Through Difficulty&#8221;. I\u00a0believe we can make the stars reachable for everyone. But it will not\u00a0happen without commitment and effort. I\u2019m in.
